Terms of Use

These Terms of Use regulate the conditions under which users are offered access to and use of the LOLA HOME APP operation by SIMON (hereinafter, "the Application"). The residential Application constitutes the interface through which the user accesses and uses the service, which is made up of the Application, as well as the other components (technological infrastructure and connected devices), hereinafter referred to collectively as "the Solution".

LOLA HOME APP, as well as the content and services included therein, allows users to use the various options offered by the Solution with the goal of home automation in their installation.

The owner of the Application is SIMON, S.A. (hereinafter, "SIMON"), with CIF A-08078651, registered office at C/ Sancho de Ávila 79-101, 08018, Barcelona, registered in the Commercial Registry of Barcelona, Sheet 20.842, Folio 090, Book B-12955.

The use of the Application implies the full acceptance of these Terms of Use. If you do not agree with its content, you should refrain from installing or using the Application.

By accepting these Terms, the user declares:

• That you have read, understand and comprehend its content.
• That you assume all obligations included therein.
• That you are over 16 years of age and have sufficient capacity to contract.

SIMON reserves the right to modify these Terms of Use at any time, for technical, legal, organizational or evolutionary reasons of the Application's functionalities.

Modifications will be published in the Application itself and will be applicable from the date indicated in them. Continued use of the Application after the publication of new terms will imply acceptance of the modifications made.

The current Terms of Use are available in the Application.

In order to use the Solution, prior registration as a user (hereinafter "User"), acceptance of these Terms of Use and the Privacy Policy is required.

In order to access the Application's services and acquire User status, it is necessary to complete the registration process and generate an access key. In the registration process, an application identifier is selected, which will be the email address and a password.

Once the registration is complete, a confirmation email will be sent to the User to validate the account. The User must confirm this validation in order to activate your account and access the Application.

The data provided during registration will be used as a procedure for identification and authentication to access the Application.

The User guarantees that all information provided in the registration form is truthful, complete and up-to-date, committing to keep it properly updated at all times.

The password chosen by the user will be personal and non-transferable. As such, the User commits to make diligent use and keep the chosen password confidential. In the event that the User knows or suspects loss, theft or use of your password by third parties, you must notify SIMON as soon as possible.

SIMON will not request by any means, whether by email or otherwise, that the User inform SIMON of their password.

The processing of personal data provided by the user will be in accordance with the Privacy and Cookie Policy.

The use of the Application is entirely voluntary and is carried out under the responsibility of the user.

The use of the Application is under the exclusive responsibility of the user, who commits to doing so in a diligent, lawful manner and in accordance with these Terms. In particular, you commit, in a merely enunciative and non-exhaustive manner, to refrain from:

1. Using the Application in a way that produces or may produce effects and/or for purposes contrary to the law, morality and generally accepted good customs or public order;
2. Introducing or disseminating computer viruses, malicious code or performing acts that may damage or overload the operation or damage of SIMON's systems.
3. Violating intellectual or industrial property rights of SIMON or third parties.
4. Reproducing, copying, distributing or modifying the Application without authorization.
5. Using the Application to control devices in a home without the knowledge or consent of the occupants.

The user will be responsible for any damages of any kind that SIMON may suffer, directly or indirectly, as a result of the breach of any of the obligations arising from these Terms of Use or the law in relation to the use of the Solution.

Certain functionalities of the Application require access to resources of the User's mobile device. These accesses will be requested when necessary for the use of some functionalities and for the following purposes:

Camera. The Application may request access to the device's camera for the sole purpose of scanning QR codes, necessary for the activation, configuration or linking of compatible devices.

In no case will the Application capture, store or process images, videos or biometric data of the User.

Local Network Devices. The Application may request access to the User's local network for the purpose of detecting compatible devices connected to the same WiFi network, as well as facilitating pairing, activation, configuration or diagnosis processes for such devices.

Location. On certain devices, the operating system requires the granting of location permission to be able to access the name of the WiFi network to which the mobile device is connected and verify that it is on the same network as the devices you want to configure. This access is used exclusively to identify the network and allow configuration or linking of compatible devices, when the process is not carried out through QR code reading.

Access to these resources will be governed by the following conditions:

• Permissions will be requested at the time of use of the corresponding functionality. Once accepted, the User may revoke the permission at any time from their device settings.
• Denial of permission may limit the use of certain functionalities, but will not prevent general access to the Application.
• SIMON will not be responsible for the content or veracity of QR codes scanned from third parties outside of SIMON.

SIMON does everything possible to ensure that the Application is available and fully functional. However, and to the maximum extent permitted by law, SIMON does not warrant that the Application will always be available, will function without interruptions or will be error-free. In particular, but without limitation, SIMON will not be responsible in the event of:

1. Technical errors that prevent normal use and that result from cases of force majeure, fortuitous event or similar;
2. Maintenance work that affects the availability and/or access to the Application;
3. Damages and losses of any kind that may result from the presence of viruses or the presence of other harmful elements in the content that may cause alteration in computer systems, as well as in documents or systems stored therein;
4. Incorrect use of the Application, use contrary to law and/or these Terms of Use or any other obligation that the User has assumed toward SIMON;
5. That an unauthorized third party accesses the Platform;
6. Negligent management by the User of access credentials to the Application;
7. Loss of data or failures due to non-standard configurations of the user's device.
8. QR codes or data entered by third parties outside of SIMON.

SIMON excludes any kind of warranty, and therefore is free from all liability arising from the points expressed above, as well as from other aspects that may not be covered in this document.

The User will hold SIMON harmless against any claim, action, demand, or liability of any other kind (including any reasonable legal costs and expenses), linked or arising from, or allegedly arising from a use of the Application in a manner contrary to law, or failure to comply with what is established in these Terms of Use or any other obligation that the User has assumed toward SIMON.

All content of the Platform, understood as such, in a merely enunciative manner, texts, photographs, graphics, images, icons, technology, software, links, domains, trademarks and other audiovisual or sound content, as well as its graphic design and source code, are the exclusive property of SIMON or third parties, whose rights SIMON recognizes, where appropriate, and are subject to intellectual and industrial property rights protected by national and international law.

Any use of any of the elements subject to industrial and intellectual property is strictly prohibited for any purpose, especially commercial, as well as its distribution, public communication, modification, alteration, transformation or decompilation, except with express written authorization from SIMON.

Both the processing of any personal data that the user provides or is generated through the use of the Application, as well as, where applicable, the use of cookies, will be carried out in accordance with the Privacy and Cookie Policy.

The user must read and accept that Privacy and Cookie Policy before providing their personal data and accessing the Application.

These Terms of Use will be governed and interpreted in accordance with Spanish law.

For the resolution of any dispute that may arise from the use of the Application, the parties expressly submit to the Courts of Barcelona, except where consumer protection legislation establishes another mandatory jurisdiction.
